That scenario is now legally possible under Australia's new Migration Amendment (2026 Measures No. 1) Act, which passed parliament in March 2026. What does the new law actually say?
The Migration Amendment (2026 Measures No. 1) Act introduces what the government calls 'arrival control determinations.' In plain terms, the Minister for Home Affairs can now issue a determination that prevents visa holders from specific countries from physically entering Australia — even if their visa is valid and has been formally granted.
This is the first time in Australian migration history that a lawfully granted visa does not automatically guarantee the right to enter Australia. Previously, a visa grant meant you could travel. That is no longer guaranteed.
Who does this affect?
- →Nepali students with approved Student visas (Subclass 500) who haven't yet travelled to Australia
- →Graduate visa (Subclass 485) holders currently outside Australia
- →Anyone on a temporary visa from a country that may be subject to a future determination
- →Family members travelling on dependent visas linked to a primary holder from an affected country
Visa fees have also increased significantly
Alongside the new arrival controls, the Act also raises visa application fees — a cost you pay even if your visa is refused or if arrival is later blocked:
- →Student visa (Subclass 500): increased from AUD $1,600 to AUD $2,000
- →Graduate visa (Subclass 485): nearly doubled from AUD $2,300 to AUD $4,600
- →These fees are non-refundable if your visa is refused
Important: Nepal was already moved to Assessment Level 3 in January 2026, meaning Nepali student visa applicants face stricter documentary requirements. This new law adds another layer of risk on top of that change.
Why has Australia introduced this law?
The Australian government says the measure is designed as an emergency tool — intended for use during international crises, security threats, or situations where uncontrolled arrivals could overwhelm the immigration system. It follows significant pressure on Australia's migration infrastructure after record international student numbers in 2023 and 2024.
Critics, including student unions and immigration lawyers, argue the law is too broad and creates unacceptable uncertainty for genuine students who have made significant financial and life commitments based on a visa approval.
What should Nepali students do now?
